      If you buy a DVD, you can call your friends to watch, but you can't make a public exibition, turning your house in a movie theather, even if it's free. It's not how it should be, it's how it is.

    How about we don't treat corporations as people? Restrict companies - those with the power (in the current system) to endlessly litigate, and with the biggest incentive to abuse that power to endlessly litigate - from suing individual private citizens over anything but mass wholesale reproduction and distribution of their works.

    I can get behind needing to license things for commercial use, but there should never ever be any legal liability for any non-commercial, non-profit use, with the sole exception of wholesale reproduction and distribution. If people don't buy because they saw someone else using the product and decided that was enough, then it's the company's problem and their responsibility to make a better product.

    Love this format of long videos I got that is more difficult to make a entertaining 40 minutes video since is difficult to make a 5 minutes one, and it's even more difficult to convince people giving it a chance or even watching it all... but I'd love it, I always loved documentaries and growing up I moved from documentaries to science and culture channels on YouTube and is content like this that really make me think that this is better than anything I could have found on Discovery channel. Please keep doing long videos, maybe even on a regular schedule in an ideal world

    Hi Tom, awesome video! But you're dead wrong about video games. The vast majority of (at least indie) game devs actually seek out people to play and stream and make videos of their games. It's a dream come true for indies. Exposure absolutely does "pay the rent" -- without exposure you have nothing. Nobody will buy your game just by hearing the name. And nobody will not buy your game just because they saw a video. If somebody saw your video and chose not to buy the game, they are likely the same people that would have bought it, played an hour, and refunded it anyway.

    My understanding is that copyright and patent are an understanding between the creator and the state where the state will give the creator protection for a few years while the creation is monetised, and in return after that time the work becomes public domain and the public is free to use it as they will. There's no way that the extraordinary time periods that copyright lasts can be justified under those terms. In addition there is no way that the disparity between the period a pop song is protected and the period a scientific invention is protected can be justified.
    The industries that depend upon copyright have spent a lot of time and effort convincing people that copyright is some sort of moral right and it's beach is theft, but it's not, it's just a pragmatic arrangement between creators and the public to encourage creators while preserving public access to creative works.

    Everything that is popular and enters pop-culture should have lesser copyright protection and enter public domain sooner. When something is such a big part of the public space, it's only natural that it's no longer yours, it's everyone's. That way it would be more aligned with the way how should copyright work as naturally perceived.

    Feels like you're interpreting Fair Use more strictly than it's actually meant to be, holding "commentary and criticism" AND "parody" to pertain to the original work, which is not the case. Let's say I'm reviewing a movie about the Vietnam war, and the movie misses a key point best summarized in Tim O'Brein's The Things They Carried. I directly quote three paragraphs from his novel. That's fair use, just as quoting a few paragraphs from a news article by a student or teacher for use in a lesson is fair use. While you may argue that the merits of Fair Use would have to be argued in court, and there are plenty of lawyers who would say no to this, I feel most objective lawyers would argue that your interpretation is more narrow than it was meant to be. While erring on the side of caution may benefit content creators on youtube and other platforms, I don't know that the public is ever served by misinformation.

    Here's what you should do with your copyright. Take note that Chyna has a counterfeit BMW, Toyota, and many other companies. In many cases, the car is exactly the same except the logo is changed by rearranging a few elements. And when those companies tried to get their fair claim, the ChyGov. told companies like Toyota "The cars do look exactly the same but our engineers made the car design before you did". These copyright issues are worth billions of dollars if not trillions and yet there is zero effort in regards to solving those issues.

    It IS broken, though, because it causes tons more harm than good.
    It threatens poor nobodies with legal action that can potentially ruin lives or cause massive psychological problems. It's a system that works against the people just for the sake of making things clear-cut for huge businesses. It's not okay.

      with the current state of copyright law what alternate solution is there? None, unfortunately. The blame needs to be directed at the copyright law itself and not the systems youtube puts in place to deal with it.

    I genuinely believe that the world would be better off with NO copyright/patent/intellectual property law whatsoever than with the system that currently exists. Gimme artistic anarchy, I'd love to see what happens.
    Maybe it'd lead to a dystopia where no one created art anymore, like people assume it would. I happen to believe the human drive for creativity wouldn't allow that.

    My opinion is that you tubers and big companies shouldn’t be treated the same. Sure there exceptions, but a large majority aren’t posting for profit! Some do make their living off commentary etc, so maybe those laws should be worked around and jimmied with. But to restrict such a large population of creative people would piss me off.

    I 100% agree. Copyright terms need to be shortened, copyrights disputes need to be easier to do on a human budget, and copyright law needs to be clarified. One other thing that I think is a rare opinion is that in order to retain a copyright you must maintain a copy of the copyrighted work set up to be made publictly available at the time of expiration. Copyright holders should be offered, at the core, the same deal as patent holders. That deal is between the IP holder and the public, mediated by the government, and the terms are that the IP holder will create intellectual property for betterment of the human condition and accept that at the end of the term of their IP it will become freely available to all, and in exchange they will be allowed to profit from a personal monopoly for an amount of time which is long on the scale of their own life but short on the scale of society.
